What is a Traumatic Brain Injury?

A Traumatic Brain Injury (TBI) occurs when a sudden, external physical force disrupts the normal functioning of the brain. TBIs are broadly categorized into two major classifications depending on the nature of the physical trauma:

  • Closed Brain Injuries: These occur when a violent blow, jolt, or rapid deceleration causes the brain to slam back and forth against the hard interior walls of the skull. While the skull remains intact, the microscopic tearing of brain tissue, bruising, and internal swelling can cause massive, long-term cognitive damage.
  • Open (Penetrating) Brain Injuries: These occur when an object—such as a fractured piece of skull, a bullet, or debris from a high-impact collision—breaks through the protective skull barrier and directly enters the delicate brain tissue. Open brain injuries typically result in severe focal damage and carry a heightened risk of infection and permanent disability.

Brain injuries range widely in medical complexity and severity. Our legal team regularly represents victims suffering from all forms of head trauma, including:

  • Concussions: Often minimized as "minor" head injuries, concussions are a form of mild-to-moderate TBI that can cause persistent, life-disrupting cognitive challenges, especially if a victim experiences Post-Concussion Syndrome (PCS).
  • Brain Contusions: A direct bruising of the brain tissue, often accompanied by localized bleeding and swelling that may require surgical decompression.
  • Coup-Contrecoup Injuries: Occurring when the force of an impact is so violent that it bruises the brain at the initial site of impact and on the exact opposite side of the brain as it rebounds against the skull.
  • Diffuse Axonal Injuries (DAI): Caused by severe rotational forces—such as a violent car rollover—where the brain rotates rapidly inside the skull, causing widespread, microscopic tearing of the brain’s connecting nerve fibers (axons). DAIs frequently result in prolonged comas.
  • Hypoxic/Anoxic Brain Injuries: While not caused by external trauma, these occur when the brain is deprived of oxygen (e.g., due to near-drowning, medical malpractice, or carbon monoxide poisoning), leading to rapid, irreversible brain cell death.
