What Constitutes Assault in California?

It’s important to understand that assault and battery aren’t synonymous crimes under state law. Assault is defined as “an attempt to use force or violence on someone else” (PC §240). On the other hand, battery is defined as “the actual use of force or violence on someone else” (PC §242). 

Is Physical Contact Necessary to Constitute Assault?

No. In addition to physical contact, threats or attempted acts of violence also constitute assault. For example, if someone threatened to hit you but never actually did, this still constitutes assault. However, keep in mind that there must be evidence of harm or injury resulting from the assault to successfully recover damages in a civil claim.
